Photographer agreement
Version 2026-10-27
Selling on SurfMugs
You upload photos from surf sessions, set a price for each one, and SurfMugs sells them to surfers as digital downloads. SurfMugs runs checkout and customer support for those sales.
Fees and payouts
SurfMugs keeps 20% of each photo's price and you receive the rest, unless we've agreed a different rate with you in writing (for example, a locked-in rate for early photographers). Card processing fees are paid by SurfMugs out of its share.
Payouts are made by Stripe, our payment processor, to the bank account you connect during setup, normally weekly. You also agree to Stripe's Connected Account Agreement during setup. You're responsible for your own income taxes; Stripe may issue you tax forms.
Your photos
You keep the copyright in your photos. You give SurfMugs permission to store them, show watermarked previews, deliver full-resolution files to buyers, and feature previews on SurfMugs to promote your sessions, for as long as they're listed and as needed to serve past buyers.
Buyers get a personal-use license to the photos they buy: they can keep, print and share them, but not resell them or use them in advertising without your permission.
What you agree to
- You took the photos yourself, or have the right to sell them.
- You shot them lawfully, from public places or with permission.
- They don't contain anything illegal, explicit or demeaning, and you won't misrepresent the session time or place.
Removal requests
Anyone can ask us to remove a photo, for example a person in it who doesn't want it sold. We review each request and may hide or remove photos at our discretion. Buyers who already purchased a removed photo may keep it.
Refunds and disputes
Sales are normally final. If SurfMugs refunds an order or a buyer's bank reverses a payment, your share of that sale is taken back from your Stripe balance. See the terms of purchase.
Ending or changing this agreement
You can stop selling at any time by hiding your sessions. SurfMugs may suspend accounts that break this agreement. If we change it, we'll show you the new version in your studio and ask you to accept it before you create new sessions.
